Australian Consumer Law

The Australian Consumer Law (ACL) applies nationally and gives every Adelaide shopper a baseline set of protections. It's enforced by the ACCC at the federal level and by state and territory consumer agencies — in SA, that's Consumer and Business Services.

Your key ACL rights

  • Statutory guarantees on goods

    Goods must be of acceptable quality, fit for purpose and match their description — regardless of any warranty offered by the seller.

  • Right to repair, replace or refund

    For a minor failure, the business chooses the remedy. For a major failure (unsafe, substantially unfit, can't be fixed in reasonable time), you choose: full refund, replacement or compensation.

  • Cooling-off for unsolicited selling

    Door-to-door and unsolicited telephone sales come with a 10-business-day cooling-off period to cancel without penalty.

  • Protection from misleading conduct

    Businesses cannot mislead or deceive consumers — about prices, features, country of origin, endorsements or anything else.

  • Unfair contract terms

    Standard-form consumer and small-business contracts cannot contain terms that create a significant imbalance — unfair terms are void.
